Gladtrotter, SASU, (“Gladtrotter,” “we,” “us,” “our”) provides its services to you through its website located at:
https://gladtrotter.com (the “Site”) and related services ( the ‘Services’) subject to the following Terms & Conditions.
We reserve the right, at our sole discretion, to change or modify portions of these Terms of Service at any time without further notice. We will post the changes to these T&C’s on this page and will indicate at the top of this page the date these terms were last revised.
It is your responsibility to regularly check Gladtrotter to determine if there have been changes to these Terms of Service and to review such changes.
Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service, regardless of whether you are a website visitor, a traveler or a guide. If you do not accept , your only recourse is to stop using Gladtrotter.
Gladtrotter may at any time, without prior notification, suspend or interrupt, for a certain amount of time or definitively, to access to a part or the totality of the platform, if a violation of the terms and conditions is detected, or for any other objective reason.
2. Our services
Gladtrotter is an online platform where travelers can book tours and activities with local guides all over the world.
Through www.gladtrotter.com, guides create and post profiles that provide information about their biography, guides’s knowledge and experience, and make themselves available to offer certain services to Travelers at a particular destination (each such service, an “Activity”). Travelers select Guides (or request that Gladtrotter attempt to connect them to a Guide) to provide the Traveler with an Experience.
Gladtrotter is not an operator of tours, activities or Experiences, nor is it a provider of tours or activities;
Guides are not linked to Gladtrotter by any employment contract.
Each visit must be approved by both parties on www.gladtrotter.com
3. Legal entity
Gladtrotter is a private company having its offices in Paris, France, 17 Avenue de Ségur 75007, registered with the Chamber of Commerce in Paris under number 811 959 618 RCS PARIS. .
Gladtrotter commits to not transmitting the information provided by the Guides nor the Travelers and to respecting the confidentiality of these information, except for the information made available to the public on the User profile (name, first name, age, home town, etc.) and the information made available to Stripe as defined in the “Payment and Service Fees” section.
5. Registration obligations
You are required to register with Gladtrotter in order to access and use certain features of the Service.
If you choose to register for the Service, you agree to provide and maintain true information about yourself.
You must be more than 18-years-old to to be registered on www.gladtrotter.com
Password and Security
You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for any and all activities that occur under your password or account.
You agree to immediately notify Gladtrotter of any unauthorized use of your password or account or any other breach of security.
Gladtrotter will not be liable for any loss or damage arising from your failure to comply with this security principle.
Conditions of Use
You are solely responsible for all information, data, text, music, pictures, video, messages or other materials (“content”) that you upload, post, publish or display on www.gladtrotter.com.
Exchange rate is made on the basis of datas provided by the European central Bank
6. Modifications to Service
Gladtrotter reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part ) with or without notice. You agree that Gladtrotter will not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
Except in the case of an ‘Instant booking Event’ (as defined below), if a booking is requested for the guide’s Experience via the Services, the guide will be required to either confirm or reject the booking within 24 hours of when the booking is requested, as determined by Gladtrotter in its sole discretion, or the booking request will be automatically cancelled.
If the Guide is unable to confirm or decide to reject a booking of an Experience within the specified timeframe, any amounts collected by Gladtrotter for the requested booking will be refunded to the applicable Traveler’s credit card and any pre-authorization of such credit card will be released.
Gladtrotter enable the Guide to create a listing for each activity, that is pre-scheduled for a specific time and date, where the Traveler’s booking may be automatically confirmed (an “instant booking activity ”).
When a booking is requested via the Services, Gladtrotter shares with Guide the first and last name of the Traveler who has requested the booking and a link to the Traveler’s Gladtrotter Account profile page.
When a booking is made by the Traveler on www.gladtrotter.com, Gladtrotter delivers the reservation to the selected guide and check availability.
The Traveler definitively books the visit by paying online using a credit card. The payment confirmation sent by gladtrotter is a booking confirmation. Once the booking is confirmed, the Traveler and the Guide are committed and respectively receive a booking confirmation email and a booking notification email. The Guide is free to refuse the visit, in which case the traveler will be informed by email and will be reimbursed.
8. Gladtrotter fees and Guide payment
8.1 Gladtrotter fees
Gladtrotter applies 2 types of fees to ensure the development, maintenance and improvement of its services:
Booking fee: 5%
It is charged to Traveler and partly covers banks transactions costs.
This 5% fee, VAT included (VAT stands at 20% in France), is added to the total amount of the Activity and is transparent to the Traveler.
If the Guide asks for € 100 , the Traveler will be charged and will pay:
100 x 1.05 = € 105 (€ 5 corresponding to Gladtrotter booking fee).
Service fee: 15%
It is charged to the Guide and collected during the payment of compensation by Gladtrotter.
This 15% fee, taxes included (VAT stands at 20% in France), is calculated on the basis of the total amount requested by the Guide.
If the Guide asks for € 100, 15% will be deducted by Gladtrotter: 100 x 0.15 = € 15
The Guide will be paid € 85
The conditions described below apply in the context of a normal booking procedure.
8.2 Guide payment
The Traveler has a 24 hour delay after the scheduled completion of the experience to inform Gladtrotter of any violation of Gladtrotter terms and conditions.
After this period, the financial compensation will be paid to the Guide with no further possible contestation. This financial compensation equals the price asked by the Guide minus Gladtrotter Fees (VAT included)
Payment via Paypal
The guide who has registered a PayPal account to receive his payments recognizes and authorizes Gladtrotter to take the funds from its Stripe account and to transfer them to Gladtrotter’s bank account. Gladtrotter will then transfer these funds via Paypal to the email address specified during the Guide registration.
The guide recognizes that Gladtrotter cannot be held responsible for additional taxes or fees that may be charged by PayPal.
Payment by bank transfer
Except via Paypal, Gladtrotter only agrees on paying the Guide by bank transfer.
In order to do so, the Guide should communicate to Gladtrotter his bank details and a scanned version of his ID when creating his Gladtrotter profile.
Depending on the bank, the time to observe the payment of the compensation by Gladtrotter may vary (usually between 24H - 72H).
Gladtrotter cannot be held responsible to the Guide for any payment incident if, for any reason, the amount paid by the Traveler has to be paid back in the particular case of an opposition to payment from the bank or fraudulent use. The Guide commits to pay back to Gladtrotter, at Gladtrotter’s request, any amount that may be concerned by such incident.
From travelers :
Traveler will be 100% refunded.
Guide will not be paid.
Must be made 72 hours to 12:00 AM local time the day the experience is scheduled.
Traveler will be refunded 85% of the total price ( 15% corresponding of Gladtrotter fees)
Guide: will not be paid.
Travelers will not be refunded at all.
The guide will be fully paid,
If travelers cancel before the beginning of the visit, the time slot for the visit will be made available for other booking on www.gladtrotter.com.
All bookings must be confirmed within 24 hours.
If the guide rejects or do not confirm within this time range, the booking request expires and no payment will be made.
Any cancellation from guides conduct to 100% reimbursement to the Travelers.
Cancellation due to outside factors.
Certain Experiences may depend on factors outside either party’s control, such as weather (“Outside Factors”). The Guide has the discretion as to whether Outside Factors will prevent the Experience from taking place. As a Guide, if you need to cancel an Experience due to Outside Factors, you must contact the Traveler and Gladtrotter (at support@gladtrotter) as early as possible.
Gladtrotter provides an email address that will receive all of the complaints: email@example.com.
This service is provided in order to deal with disputes related to cancellations. The litigation service has not obligation to find a solution to litigations between the Users. If no solution is found between the Guide and the Traveler, Gladtrotter will retain the amounts paid by the Traveler until a private agreement is found, or a court ruling is rendered.
10. Applicable taxes
It is a Guide’s sole responsibility to determine which taxes are applicable and required to comply with the applicable local tax law and pay any corresponding taxes.
11. Proprietary Material
Glatrotter is a registered trademark (No. 15 4 211208, INPI). Logo and brands available on this site are owned by Gladtrotter.
All text, graphics, editorial content, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces and other content (collectively "Proprietary Material") that you see or read on this website is owned by us, or is used with the owner’s permission. This Proprietary Material is protected in all forms, media and technologies. You may not copy, download, use redesign, reconfigure, or retransmit anything from this website without our prior written permission.
12. Respect of law
Travelers should be aware of the laws applicable in the country they visit, as well as the rules of the places they will be visiting.
Gladtrotter accepts no responsibility should a Visitor violate any law or rule applicable to the cities and places they visit.
We do not warrant that our website and/or our services will be uninterrupted or error-free. Gladtrotter commits to making the platform available 24/7.
However, updates and maintenance operation are necessary to provide you with a an even better service, that will result in a temporary suspension of the platform.
Guides and Travelers aknowledge and accept that Gladtrotter takes no responsability for any unavailability or interruption of Gladtrotter.com and will not be held responsible for any direct or indirect prejudice.
The use of our website and services and participation in any of the events hosted by guides is solely at your own risk.
Guides and Travelers are responsible for their own actions. In consequence, Gladtrotter, being an intermediary, is not responsible for anything that could happen during the Activity.
Gladtrotter will not be responsible in the event of a fraudulent use of payment instrument by the Traveler. In this situation, no guarantee of payment is given to the Guide by Gladtrotter.
We hereby disclaim all warranties and conditions with regard to the use of our website and/or services, including, but not limited to, the availability, reliability, or quality of our website and services, the events distributed through us, including the nature and quality of the events, and is not and shall not be responsible for any error, fault or mistake of any and all content and information received through our us, including by hosts or travelers. We do not endorse any entity, product or service mentioned in any user generated content available on our website.
